Harmonisasi aturan hukum buruh migran Antara International Convention on the Protection of the Rights of All Migrant Workers and Member of Their Families dan Undang-Undang Nasional

Abstrak Penelitian ini bertujuan untuk mengetahui, pertama, perlindungan hukum yang diberikan terhadap buruh migran oleh International Convention on the Protection of the Human Rights of All Migrant Workers and Member of Their Families Undang-Undang dan Undang-Undang nasional. Kedua, keharmonisan pengaturan pelindungan hukum buruh migran antara International Convention on The Protection of The Rights of All Migrants Workers and Member of Their Families dan Undang-Undang nasional. Penelitian ini merupakan penelitian hukum normatif. Jenis data yang digunakan yaitu data sekunder. Sumber data sekunder yang digunakan mencakup bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Teknik pengumpulan data yang digunakan yaitu studi pustaka dengan cara identifikasi isi. Teknik analisis data yang digunakan ialah teknik pola pikir deduktif. Hasil penelitian ini menunjukkan bahwa, pertama, perlindungan hukum yang diberikan terhadap buruh migran oleh International Convention on the Protection of the Human Rights of All Migrant Workers and Member of Their Families dan Undang-Undang nasional secara berturut-turut diatur dalam Bab III hak azasi bagi buruh migran dan anggota keluarganya, terdiri atas Pasal 8–Pasal 35 dan Bab IV hak-hak yang didokumentasikan atau yang berada dalam situasi normal, terdiri atas Pasal 36-Pasal 56. Dalam Undang-Undang nasional diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan Pasal 67-Pasal 80, Pasal 84 dan Pasal 85, Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia di Luar Negeri Pasal 77-Pasal 84 dan Pasal 90, Undang-Undang Nomor 37 Tahun 1999 tentang Hubungan Luar Negeri Pasal 18-Pasal 22, Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia Pasal 38, Pasal 39 dan Pasal 49. Kedua, belum adanya keharmonisan antara pengaturan perlindungan hukum yang diberikan terhadap buruh migran oleh International Convention on the Protection of the Human Rights of All Migrant Workers and Member of Their Families Undang-Undang dan Undang-Undang nasional. ABSTRACT This research is aimed to determine, first, the law protection given to migrant workers by the International Convention on the Protection of the Human Rights of All Migrant Workers and Members of Their Families and the national laws. Second, harmonization of the legal rules of migrant workers between the International Convention On The Protection Of The Rights of All Migrants Workers And Members Of Their Families and national laws. This research is a normative legal research. Types of data used are secondary data. Secondary data sources used includes the primary, secondary and tertiary law materials. Data collecting technique used is document study with content identification. Data analysis technique used is a deductive mindset. The results of this researh are, first, the law protection given to migrant workers by the International Convention on the Protection of the Human Rights of All Migrant Workers and Members of Their Families and the national laws in a row set in Chapter III of rights for migrant workers and members of his family, Article 8-Article 35 and Chapter IV of the rights that are documented or who are in normal circumstances, Article 36-Article 56. In national laws regulated in Statute No. 13 Year 2003 on Labor Article 67-Article 80, Article 84 and Article 85, Statute No. 39 Year 2004 on Placement and Protection of Indonesian Workers Abroad Article 77, Article 84 and Article 90, Statute No. 37 of 1999 on Foreign Relations Article 18, Article 22, Statute No. 39 Year 1999 on Human Rights Article 38, Article 39 and Article 49. Second, there is no existing harmony between the law protection given to migrant workers by the International Convention on the Protection of the Human Rights of All Migrant Workers and Members of Their Families and national laws.
