Implikasi sistem publikasi negatif dengan unsur positif terhadap kekuatan pembuktian sertifikat hak atas tanah (Studi Kasus Kekuatan Pembuktian Sertifikat HM. 4811 dan HM. 4538, HM. 4812 dan HM. 4547, HM. 4813 dan HM. 4414 serta HM. 5043, HM. 4814 dan HM

ABSTRAK
Penelitian ini merupakan penelitian hukum normatif bersifat preskriptif. Jenis data yang digunakan yaitu data sekunder. Sumber data sekunder yang digunakan mencakup bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data yang digunakan yaitu studi kepustakaan. Kemudian data tersebut dimintakan penjelasan dan konfirmasi dari pejabat Kantor Pertanahan Kota Surakarta, yaitu Seksi Hak Tanah dan Pendaftaran Tanah, Seksi Survei Pengukuran dan Pemetaan serta Sub Seksi Sengketa dan Konflik Pertanahan. Analisis data yang digunakan berupa silogisme deduksi dengan interpretasi bahasa (gramatikal).
Berdasarkan hasil penelitian dan pembahasan dihasilkan simpulan, kesatu, penerbitan sertifikat HM. 4811 dan HM. 4538, HM. 4812 dan HM. 4547, HM. 4813 dan HM. 4414 serta HM. 5043, HM. 4814 dan HM. 4337, HM. 4815 dan HM. 4403, HM. 4816 dan HM. 4543 serta HM. 4504 di Kelurahan Kadipiro Surakarta belum memenuhi asas aman pendaftaran tanah. Kedua, Terjadinya sertifikat ganda merupakan konsekuensi logis dari sistem publikasi negatif dengan unsur positif yang diterapkan di Indonesia. Sistem publikasi negatif dengan unsur positif dalam pendaftaran tanah di Indonesia tidak memberikan kepastian hukum terhadap Sertifikat HM. 4811 dan HM. 4537, HM. 4812 dan HM. 4547, HM. 4813 dan HM. 4414 serta HM. 5043, HM. 4814 dan HM. 4337, HM. 4815 dan HM. 4403, HM. 4816 dan HM. 4543 serta HM. 4504 di Kelurahan Kadipiro Surakarta. Penerbitan sertifikat yang diakui mempunyai kekuatan pembuktian yang kuat ternyata masih dapat dibatalkan atau tidak mempunyai kekuatan hukum tetap.

ABSTRACT
This research aims to find out the application of safety principle by the Surakarta City Land Affairs Office in Publishing the certificates of 4811 and 4538 Properties, 4812 and 4547 Properties, 4813 and 4414 as well as 5043 Properties, 4814 and 4337 Properties, 4815 and 4403 Properties, 4816 and 4543 as well as 4504 Properties over the lands in Kelurahan Kadipiro Surakarta.
This study belongs to a prescriptive normative law research. The data type employed was secondary data. The data source employed included primary, secondary and tertiary law materials. Technique of collecting data used was literary study. Then the data was asked for clarification and confirmation from the officials of surakarta City land Affairs Office: Land Property and Land Registration, Measurement Survey and Mapping Sections as well as land and Conflict Dispute Sub Section. The data analysis employed was deduction syllogism with grammatical interpretation.
Based on the result of research and discussion, it can be concluded that: firstly, the publication of certificates of 4811 and 4538 Properties, 4812 and 4547 Properties, 4813 and 4414 as well as 5043 Properties, 4814 and 4337 Properties, 4815 and 4403 Properties, 4816 and 4543 as well as 4504 Properties over the lands in Kelurahan Kadipiro Surakarta has not fulfilled the safety principle of land registration. Secondly, the double certificate occuring is the logical consequence of negative publication system with positive element applied in Indonesia. The negative publication with positive element in land registration in Indonesia does not give law certainty to the sertificates of 4811 and 4538 Properties, 4812 and 4547 Properties, 4813 and 4414 as well as 5043 Properties, 4814 and 4337 Properties, 4815 and 4403 Properties, 4816 and 4543 as well as 4504 Properties over the lands in Kelurahan Kadipiro Surakarta. The sertificate publication recognized having the strong verification power, in fact, still can be canceled or does not has fixed legal power.
