To execute the commendation from Section 202 Invitor the Number 32 Year 2004 about governmental Area Governance have published the Govement Regulation Number 45 Year 2007. In Section 2 Goverment Regulation Number 45 Year 2007 mentioned by that Countryside Secretary lifted lawfully up to 15 October 2004 and still execute the duty of up to going into effect this Governmental Regulation lifted direct become the Public Servant Civil, if fulfilling conditions. Liftedly of up to standard Countryside secretary as Public Servant Civil hence the Countryside secretary will own the same rights and obligations like Public Servant Civil of generally. From 208 countryside and chief of village of exist in Regency Sragen, to date there is 196 active Countryside secretary execute its duty, while the rest 12 people Countryside secretary have entered a period of to pension, so that there is blankness of position Countryside secretary. From 196 existing active Countryside secretary, only 83 one who up to standard to be lifted by as ineligible Public Servant Civil the rest and to be lifted by as Public Servant Civil. Applying of Goverment Regulation Number 45 Year 2007 in Regency Sragen have been done by through 3 phase. First phase in the year 2007. Countryside secretary proposed by a number of 50 people, and now have got the SK Lifting as Public Servant Civil. Second Phase in the year 2008. Countryside secretary proposed by a number of 20 people. To date still dirposes in Domestic Department. Phase is third by year 2009. At this phase still be done by process of conditions administrati in Body of Area Officer henceforth will be proposed to Domestic Department. Penelitian ini bertujuan untuk mengetahui implikasi Peraturan Pemerintah Nomor 45 Tahun 2007 tentang Persyaratan dan Tata Cara Pengangkatan Sekretaris Desa Menjadi Pegawai Negeri Sipil (PP Nomor 45 Tahun 2007) terhadap status hukum sekretaris desa di Kabupaten Sragen Penelitian ini merupakan penelitian yang bersifat deskriptif dan apabila dilihat dari tujuannya ermasuk peneitian hukum empiris. Lokasi penelitian di Kabupaten Sragen. Jenis data yang digunakan meliputi data primer dan data sekunder.Teknik pengumpulan data yang dipergunakan yaitu melalui wawancara dan studi dokumen baik berupa buku-buku, peraturan perundang-undangan, dan arsip. Analisis data kualitatif dengan model interaktif Untuk melaksanakan amanat dari Pasal 202 Undang Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah pemerintah telah menerbitkan PP Nomor 45 Tahun 2007. Dalam Pasal 2 PP Nomor 45 Tahun 2007 disebutkan bahwa Sekretaris Desa yang diangkat dengan sah sampai dengan 15 Oktober 2004 dan masih melaksanakan tugas sampai dengan berlakunya Peraturan Pemerintah ini diangkat langsung menjadi PNS, apabila memenuhi persyaratan. Dengan diangkatnya Sekdes yang memenuhi syarat sebagai PNS maka Sekdes tersebut akan memiliki hak dan kewajiban yang sama seperti PNS pada umumnya. Dari 208 desa dan kelurahan yang ada di Kabupaten Sragen, sampai saat ini ada 196 Sekdes yang aktif melaksanakan tugasnya, sedangkan sisanya 12 orang sekdes telah memasuki masa pensiun, sehingga ada kekosongan jabatan sekdes. Dari 196 Sekdes aktif yang ada, hanya 83 orang yang memenuhi syarat untuk diangkat sebagai PNS dan sisanya tidak memenuhi syarat untuk diangkat sebagai PNS. Penerapan PP Nomor 45 Tahun 2007 di Kabupaten Sragen telah dilakukan melalui 3 tahap. Tahap pertama dilakukan pada tahun 2007. Sekdes yang diusulkan sejumlah 50 orang, dan sekarang sudah mendapatkan SK Pengangkatan sebagai PNS. Tahap kedua dilakukan pada tahun 2008. Sekdes yang diusulkan sejumlah 20 orang. Sampai saat ini masih dirposes di Departemen Dalam Negeri. Tahap ketiga dilakukan tahun 2009. Pada tahap ini masih dilakukan pemrosesan syarat-syarat administrati di Badan Kepegawaian Daerah untuk selanjutnya akan diusulkan ke Departemen Dalam Negeri
