Analisis intervensi pemerintah terhadap Persatuan Sepakbola Seluruh Indonesia (PSSI) dikaitkan dengan prinsip independensi

Penulisan hukum ini bertujuan untuk mengetahui prinsip independensi yang melekat dalam Persatuan Sepakbola Seluruh Indonesia (PSSI) terkait dengan intervensi pemerintah yang dilakukan oleh Menteri Pemuda dan Olahraga bersama dengan Komite Olahraga Nasional (KON) terhadap PSSI Intervensi yang dilakukan pemerintah yaitu Menteri Pemuda dan Olahraga bersama dengan KON terhadap PSSI hingga saat ini masih menjadi pro kontra yang tanpa kejelasan penyelesaian masalah. Sepakbola merupakan domain FIFA yang dalam penyelenggaraan kompetisinya mempunyai sistem hukum sendiri. Sistem hukum tersebut dikenal dengan sistem hukum ketiga sesudah hukum nasional dan hukum internasional yaitu hukum transnasional yang dalam konteks ini adalah Lex Sportiva dan Lex Ludica. Namun perlu dicermati juga bahwa sepakbola dalam penyelenggaraan kompetisinya berada dalam wilayah administrasi negara terkait yang memiliki yuridiksi hukum nasional yang juga berlaku bagi penyelenggaraan kompetisi sepakbola tersebut. Di Indonesia benturan hukum tersebut terjadi hingga mengakibatkan intervensi yang dilakukan pemerintah terhadap PSSI. Permasalahan mengenai intervensi inilah yang dalam penulisan hukum ini penulis coba uraikan dikaitkan dengan prinsip independensi PSSI yang diperoleh atas keberadaan sistem hukum ketiga yaitu Lex Sportiva dan Lex Ludica Berdasarkan hasil penelitian dapat diambil kesimpulan bahwa intervesi yang dilakukan oleh pemerintah terhadap PSSI didasari oleh hukum nasional yang tertuang dalam Undang-Undang Nomor 3 Tahun 2005 tentang Sistem Keolahragaan Nasional dan Peraturan Pemerintah nomor 16 tentang Penyelenggaraan Keolahragaan. Hal tersebut jelas melanggar ketentuan sistem hukum global, di mana urusan keolahragaan merupakan urusan society bukan urusan state. Namun yang perlu dicermati adalah PSSI belum mampu memenuhi ketentuan yang diatur dalam Statuta FIFA, sehingga jika menggunakan teori pacta sunt servanda maka PSSI tidak mendapatkan hak perlindungan hukum dari FIFA atas intervensi yang dilakukan oleh pemerintah. This research aims to determine the principles of independence inherent in the Football Association of Indonesia (PSSI) related to government intervention made by the Minister of Youth and Sports together with the National Sports Committee (KON) to the Football Association of Indonesia. Intervention by the Government, the Minister of Youth and Sports together with the National Sports Committee to the Football Association of Indonesia is still being pro and contra that without clarity of problem solving. Football is domain FIFA in the implementation of competition has its own legal system. The legal system is known as a third legal system besides the domestic law and international law, it is transnational law is in this context is Lex Sportiva and Lex Ludica. However, it should be observed also that football in the administration of the competition is within the relevant state administration that has jurisdiction of national law which also applies for the holding of the football competition. Conflict of laws in Indonesia are going to result in intervention by the government against the Football Association of Indonesia. Problems of intervention in this legal research, the authors try to describe related with principle of independence as a result of the existence of transnational legal system manifested in the Considering the results of research can be concluded that the interventions made by the government against the Football Association of Indonesia is constituted by national laws as stipulated in Law Number 3 Year 2005 about national sports system and Government Regulations Number 16 Year 2007 about organization of sport. It violates the provisions of the global legal system, however, sport is a affairs of society, sport is not a state affair. But the football association of indonesia has not been able to meet the requirements prescribed in the Statutes FIFA, so if use the theory of pacta sunt servanda the the football association of indonesia does not get the right legal protection of FIFA on the interventions by the government.
