Peranan Notaris dalam Peralihan Kredit (Take Over) Antar Bank Berdasarkan Undang-Undang Perbankan (Studi di Kantor Notaris Arinto Esti Mahaningrum, S.H.)

ABSTRAK
Penelitian ini mengkaji dan menjawab permasalahan mengenai 1) penyebab terjadinya peralihan kredit perbankan (take over), 2) kewenangan Notaris dalam mekanisme peralihan kredit (take over) berdasarkan Undang-Undang Nomor 7 tahun 1992 juncto Undang-Undang Nomor 10 tahun 1998 tentang Perbankan, dan 3) hal-hal yang dihadapi Notaris dalam mekanisme peralihan kredit (take over) antar bank dan penyelesaiannya.
Penelitian ini menggunakan penelitian hukum empiris dan bersifat deskriptif.Jenis data penelitian ini adalah data primer dan data sekunder.Data primer merupakan data utama penelitian yang diperoleh langsung dari Notaris.Data sekunder merupakan data penunjang data primer. Teknik pengumpulan data yang digunakan dalam penelitian adalah studi kepustakaan dan studi lapangan.
Hasil dari penelitian dan pembahasan dalam penulisan hukum ini adalah terdapat dua macam take over, yaitu take over kredit untuk Kredit Modal Kerja (KMK) dan Kredit Pemilikan Rumah (KPR). Proses take over untuk KMK maupun KPR sama, namun take over KPR ditambahkan adanya perjanjian jual beli. Kewenangan Notaris berdasarkan Undang-Undang Perbankan dimulai saat pengikatan kredit dengan dibuatnya perjanjian kredit. Sebelum pengikatan jaminan dengan dibuatnya Surat Kuasa Membebankan Hak Tanggungan (SKMHT), dilakukan pengecekan sertifikat tanpa sertifikat asli ke Kantor Pertanahan karena sertifikat asli masih menjadi jaminan oleh pemegang Hak Tanggungan sebelumnya.

ABSTRACT
This research examines and answers the problems regarding 1) the cause of the banking credit take over, 2) the authority of notary in the banking credit take over mechanism based on Law Number: 7 of 1992 juncto Law Number: 10 of 1998 Concerning Banking, and 3) the matters encountered by Notary in banking credit take over mechanism between banks and their solution.
This research used the descriptive empirical method. The types of data of research were primary and secondary ones. The former were the main data and were gained directly from the Notary, and the latter were the supporting data. They were collected through literature study and field study.
The results of research are as follows: There are two types of banking credit takeover namely: the take over for Working Capital Credit and House Ownership Credit. The process of the take over for the Working Capital Credit and for the House Ownership Credit is similar. However, the take over for House Ownership Credit is added with the sale and purchase agreement. The authority of notary based on banking laws is in effect as of the credit binding through the credit contract drawing up. Prior to the collateral binding through the drawing up of the Power of Attorney to Charge for the Right of Land Mortgage, the certificate without the original certificate is checked to the Land Office because the original certificate has been used as collateral by the previous holder’s Right of Land Mortgage.
