ABSTRACT
The legal research methods used in the study is normative method. Based on the nature of the study, this research is included in prescriptive studies that studied law purposes, the values of justice, the validity of the rule of law, legal concepts, and legal norms.
The conclusion of this legal research is concerning the provisions of Article 13 before the amendments of the Constitution of the Republic of Indonesia 1945 is stated that the authority on appointing the Ambassador of the Republic of Indonesia for other countries is the prerogative of the President without the application of the system of checks and balances. After the amendments of the Constitution of the Republic of Indonesia 1945, with the purpose of realizing the checks and balances system as a condition for the application of pure presidential system, Article 13 has mandated that the appointment of the Ambassador of the Republic of Indonesia for another country is the prerogative of the president, but by taking the Parliament consideration.
