<p class="MsoNormal" xss="removed" xss=removed><span lang="id" xss="removed">Penelitian ini bertujuan untuk menelaah bagaimana



mekanisme pertanggungjawaban dalam pelanggaran yang disebabkan oleh <i>Autonomous Weapon Systems </i>(AWS) pada



konflik bersenjata. Bentuk pertanggungjawaban atau responsibilitas terbagi



menjadi tiga kategori secara umum, yaitu <i>state



responsibility </i>untuk negara, <i>command



responsibility </i>untuk komandan, dan <i>individual



responsibility </i>untuk operator yang terlibat secara langsung dalam



pengoperasian senjata otonom. Selain itu, terdapat analisis mengenai teori <i>product liability </i>dan apakah teori ini



dapat diimplementasikan khususnya terhadap programmer algoritma dari AWS.</span></p>







<p class="MsoNormal" xss="removed" xss=removed><span lang="id" xss="removed">Penelitian ini merupakan penelitian hukum normatif



dengan pendekatan perundang-undangan (<i>statute



approach</i>) dan pendekatan konseptual (<i>conceptual



approach</i>). Data yang digunakan pada penelitian ini ialah data sekunder.



Adapun teknik pengumpulan data dilakukan melalui studi kepustakaan (<i>library research</i>), kemudian data yang



terkumpul dianalisis menggunakan metode silogisme deduktif.</span></p>







<i><div xss=removed><i><span lang="id" xss="removed">Autonomous Weapon Systems </span></i><span lang="id" xss="removed">(AWS) atau senjata



otonom merupakan sarana berperang yang dijalankan melalui sistem <i>Artificial Intelligence </i>(AI). Algoritma



yang terpasang di dalamnya memberikan benefit bagi senjata ini untuk beroperasi



secara efektif dan efisien. Di lain sisi, kapabilitas dari senjata ini



menimbulkan banyak pertanyaan berkaitan dengan kepatuhannya terhadap



prinsip-prinsip HHI. Tidak hanya itu, permasalahan responsibilitas juga masih



menjadi persoalan dalam menjawab tantangan pada penggunaan senjata otonom. Pada



prinsipnya, pertanggungjawaban dalam pemakaian sarana berperang merupakan



pertanggungjawaban kolektif, yang berarti negara, komandan, dan kombatan dapat



dibebankan masing-masing. Akan tetapi, pada kasus AWS, terdapat kemungkinan



bagi programmer algoritma dari produk otonom untuk dibebankan tanggung jawab,

<p class="MsoNormal" xss="removed" xss=removed><span lang="id" xss="removed">This study aims to examine the accountability



mechanisms in violations caused by Autonomous Weapon Systems (AWS) in armed



conflicts. The forms of accountability can generally be categorized into three



types: state responsibility for the state, command responsibility for



commanders, and individual responsibility for operators directly involved in



the operation of autonomous weapons. Additionally, this study analyzes the



product liability theory and whether this theory can be applied specifically to



the algorithms programmers of AWS.</span></p>







<p class="MsoNormal" xss="removed" xss=removed><span lang="id" xss="removed">This research is a normative legal study using a



statutory approach and a conceptual approach. The data used in this study is



secondary data. The data collection technique is conducted through library



research, and the collected data is analyzed using the deductive syllogism



method.</span></p>







<p class="MsoNormal" xss="removed" xss=removed><span lang="id" xss="removed">Autonomous Weapon Systems (AWS) are warfare tools



operated through an Artificial Intelligence (AI) system. The algorithms



embedded within these systems provide benefits that enable these weapons to



operate effectively and efficiently. However, the capabilities of these weapons



raise numerous questions regarding their compliance with International



Humanitarian Law (IHL) principles. Additionally, the issue of accountability



remains a challenge in addressing the use of autonomous weapons. In principle,



accountability in the use of warfare tools is a collective responsibility,



meaning that the state, commanders, and combatants can each be held



accountable. However, in the case of AWS, there is a possibility that



algorithms programmers of autonomous products may also be held accountable



under product liability.<o></o></span></p></span></div>
