Penelitian ini bertujuan untuk mengetahui dan menganalisis Implementasi

UU No. 5 tahun 1990 tentang konservasi sumber daya alam hayati dan

ekosistemnya dalam menanggulangi perbuatan yang dapat mengakibatkan

perubahan terhadap keutuhan kawasan suaka alam dan kawasan pelestarian alam

Kalimantan Barat.

Jenis penelitian dalam tesis ini adalah penelitian yuridis empiris atau nondoktrinal,

berdasarkan konsep hukum yang kelima. Bentuk penelitian yang

digunakan adalah diagnostik dengan analisis data menggunakan analisis kualitatif.

Berdasarkan deskripsi hasil penelitian dan pembahasan, disimpulan bahwa

Implementasi UU No. 5 tahun 1990 di Balai KSDA Kalbar saat ini belum berjalan

maksimal. Faktor-faktor yang mempengaruhinya antara lain : 1) Masih

terdapatnya kelemahan dalam UU No. 5 tahun 1990 baik secara kualitatif maupun

kuantitatif; 2) Faktor penegak hukum, yaitu masih terdapatnya kekurangan baik

secara kualitas maupun kuantitas penegak hukum di Balai KSDA Kalbar; 3)

Kurangnya sarana dan prasarana pendukung dalam kegiatan perlindungan hutan;

4) Faktor masyarakat, yaitu masih rendahnya tingkat pendidikan dan taraf hidup

masyarakat disekitar KSA-KPA; dan 5) Faktor Kebudayaan, yaitu adanya

perubahan pola kehidupan dalam masyarakat menjadi lebih konsumtif serta

berkembangnya perilaku anarkis. Upaya yang seharusnya dilakukan dalam

mengatasi perbuatan yang dapat mengakibatkan perubahan terhadap keutuhan

This research had a purpose to know and to analyze the implementation of

the Law Regulation Number 5 the Year of 1990 o n the conservation of the natural

resource and its ecosystem in overcoming the conducts that can bring the change

to the wholeness of the wildlife reserve region and nature conservation Region

(KSA-KPA) in the West Kalimantan.

The type of this research was a juridical-empirical research or a non

doctrinal research, based o n the fifth law concept. It is a diagnostic research, using

qualitative analysis to analyze the data.

Based o n the description of the research result and its assessment, it was

concluded that at present the implementation of the Law Number 5 the Year of

1990 in the West Kalimantan Natural Resources Center has not been executed in

maximum. The efforts that had been executed to overcome the conducts which

can bring the change to the wholeness of KSA-KPA include preventive and

repressive activities. Some affecting factors are: 1) the factor of the regulation

itself (the law), there is still weakness in the formulation of the Law number 5 the

year of 1990; 2) the factor of law enforcement officer, the number of the forest

rangers were not in keeping with the extent of the KSA-KPA; 3) the factor of

means and infrastructure, there is a lack of budget and the supporting means to

protect the forest; 4) the factor of the society, the levels of education and standard

of living of the community around the forest (KSA-KPA) were still low; and 5)

the factor of culture, there is a change in the community living pattern, in which

they become more consumptive and there is a development of anarchic behavior.

As its implication, the weak implementation of the Law Number 5 the Year

of 1990 will cause the forest (KSA-KPA) degradation, the government and the

law enforcement officers will lose the society’s and the world’s trusts, and

Indonesia will be thought of as inconsistent country in managing and protecting

its conservation area. Therefore, it is suggested that the government, in particular

the West Kalimantan Natural Resources Center increases the

socialization/elucidation to the community especially those around the

reserve/conservation (KSA-KPA), intensifies the coordination with the local

government and other law enforcement bodies, balances the preventive and

enforcement officers, means, and facilities which support the law enforcement in

West Kalimantan Natural Resources Center.
