PENDAYAGUNAAN HUKUM DALAM MENINGKATKAN KESADARAN BUDAYA HAK KEKAYAAN INTELEKTUAL PELAKU EKONOMI KREATIF. Tesis: Program Studi Magister Ilmu Hukum Universitas Sebelas Maret Surakarta  Penelitian ini bertujuan untuk mengidentifikasi, mengkaji, dan menganalisis faktor-faktor penyebab rendahnya kesadaran budaya Hak Kekayaan Intelektual (HKI) di kalangan pelaku ekonomi kreatif, serta mengkaji upaya pendayagunaan hukum untuk meningkatkan kesadaran tersebut. Tesis ini menggunakan jenis penelitian empiris atau non-doktrinal yang bersifat deskriptif, dengan pendekatan socio-legal research, untuk memahami kondisi praktik di lapangan. Data primer diperoleh melalui wawancara dengan informan, sedangkan data sekunder berupa kajian terkait ekonomi kreatif dan HKI. Proses pengumpulan data dilakukan melalui wawancara dan studi pustaka, diikuti dengan analisis data yang mencakup tahapan pengumpulan, reduksi, penyajian, dan penarikan kesimpulan.Hasil penelitian menunjukkan bahwa rendahnya kesadaran budaya HKI pada pelaku ekonomi kreatif disebabkan oleh beberapa faktor. Faktor-faktor tersebut meliputi : (a) inkonsistensi kebijakan hukum dari presiden; (b) ketiadaan peraturan pelaksanaan yang mengatur kewajiban dan tanggung jawab pemerintah pusat dan daerah/kota dalam memfasilitasi HKI bagi pelaku ekonomi kreatif, termasuk mekanisme pelaksanaannya; (c) aparatur pemerintah tidak fokus dalam menjalankan tugas pokok dan fungsinya dalam pengembangan ekonomi kreatif, serta penolakan pemfasilitasan oleh Badan Anggaran Dewan Perwakilan Rakyat Daerah; (d) kurang pedulinya pelaku ekonomi kreatif terhadap permasalahan ini, kurang meratanya sosialisasi, dan masih kuatnya pola pikir mereka yang menghambat perkembangan usaha; serta (e) kurangnya pendidikan hukum pada pelaku ekonomi kreatif dan aparatur pemerintah. Selanjutnya terkait dengan upaya mendayagunakan hukum agar meningkatkan kesadaran budaya Hak Kekayaan Intelektual pelaku ekonomi kreatif, yaitu: (a) konsisten politik hukum presiden yang berkelanjutan; (b) membangun subsansi hukum (kewajiban dan tanggung jawab pemerintah daerah/kota dalam memfasilitasi kepemilakn Hak Kekayaan Intelektual pelaku ekonomi kreatif); (c) kerjasama lintas bidang antara pemerintah (aparatur pemerintah) dan swasta; (d) desiminasi ataupun sosialisasi secara masif, produktif, dan berkelanjutan.Dewandira Darruning Sripradnya Rahmaidha. 2025. S362308016. UTILIZATION OF LAW IN INCREASING CULTURAL AWARENESS OF INTELLECTUAL PROPERTY RIGHTS CREATIVE ECONOMY ACTORS. Thesis: Master of Law, Universitas Sebelas Maret Surakarta. This study was aimed to identify, scrutinize, and analyze the factors contributing to the decline or low awareness of Intellectual Property Rights (IPR) among creative economy actors, as well as to explore legal mechanisms that can be utilized to enhance their cultural awareness of IPR.This legal thesis employed an empirical research method, commonly referred to as non-doctrinal research, to examine real-world practices and provide a descriptive analysis. The study adopted a socio-legal research approach. Primary data was collected through interviews with research informants, while secondary data consisted of studies related to the creative economy and Intellectual Property Rights. The data collection process involved data gathering, data presentation, and conclusion drawing. The findings of this legal study (thesis) indicated that the factors contributing to the decline or low awareness of the Intellectual Property Rights (IPR) culture among creative economy actors include: (a) inconsistencies in the president's legal policy; (b) the absence of implementing regulations regarding the obligations and responsibilities of the central and local governments in facilitating the Intellectual Property Rights of creative economy actors, as well as the mechanisms for doing so; (c) government officials failed to focus on their core duties and functions in the development of the creative economy, along with the rejection of facilitation attempts by the Regional House of Representatives' Budget Committee; (d) the lack of concern among creative economy actors regarding this issue, unequal dissemination of information, and the persistence of mindsets that hinder business development; and (e) insufficient legal education for both creative economy actors and government officials.  Furthermore, efforts to leverage legal mechanisms to enhance the cultural awareness of Intellectual Property Rights among creative economy actors include: (a) ensuring consistency in the president’s long-term legal policy; (b) developing legal substance, specifically regulations on the obligations and responsibilities of local governments in facilitating the ownership of Intellectual Property Rights by creative economy actors; (c) fostering cross-sector collaboration between government authorities and the private sector; and (d) conducting massive, productive, and continuous dissemination and public awareness campaigns.
