× ABSTRAK Dalam penulisan tesis ini penulis membahas mengenai kebijakan yang dilakukan oleh Kepolisian Resor Sukoharjo dalam mengungkap terjadinya kasus tindak pidana pembuangan bayi dan bagaimana upaya menanggulangi dan meminimalisasi terjadinya tindak pidana pembuangan bayi oleh Kepolisian Resor Sukoharjo bersama pemerintah dan masyarakat. Hal ini dilatar belakangi dengan semakin maraknya kasus tindak pidana pembuangan bayi yang sulit diungkap karena berbagai hambatan yang dihadapi oleh Kepolisian khususnya Resor Sukoharjo. Tujuan dari penelitian ini untuk mengetahui dan menganalisis kebijakan yang telah dilaksanakan Kepolisian Resor Sukoharjo dalam mengungkap kasus pembuangan bayi yang dilakukan oleh ibu kandungnya sendiri, mengetahui dan mengkaji upaya menanggulangi terjadinya tindak pidana pembuangan bayi yang dilakukan oleh Kepolisian Resor Sukoharjo bersama pemerintah dan masyarakat. Penelitian ini termasuk jenis penelitian hukum sosiologis (non doktrinal), sifatnya penelitian deskriptif kualitatif, dengan menggunakan jenis data primer dan sekunder berupa wawacara dengan Anggota Reskrim Polres Sukoharjo. Hasil penelitian mengungkapkan kebijakan yang diambil Polres Sukoharjo dalam mengungkap kasus tindak pidana pembuangan bayi dengan langkah mengecek ke rumah sakit-rumah sakit terutama rumah sakit bersalin, pemberitaan atau ekspos ke surat kabar baik media cetak maupun elektronik, melakukan proses penyelidikan. Kebijakan yang diambil oleh Kepolisian Resor Sukoharjo kepada pelaku tindak pidana pembuangan bayi antara lain, pelaku masih bersekolah atau tidak apabila masih bersekolah maka tidak dilakukan penahanan supaya pelaku bisa melanjutkan sekolah, wajib apel bagi pelaku tindak pidana yang masih bersekolah pada hari senin dan kamis. Kendala-kendala yang dihadapi Polres Sukoharjo dalam mengungkap kasus tersebut pelaku membuang bayi di luar wilayah tempat tinggalnya, pelaku menyembunyikan kehamilannya, kurangnya proaktif dari masyarakat. Berbagai upaya penanggulangan tindak pidana pembuangan bayi juga dilakukan oleh Kepolisian Resor Sukoharjo antara lain melaksanakan bimbingan dan penyuluhan kepada masyarakat melalui Bina Mitra, menggiatkan sistem keamanan swakarsa di lingkungan masyarakat, Melakukan Patroli lingkungan setiap hari, menggelar operasi penyakit masyarakat, serta operasi terhadap peredaran VCD porno, setelah terjadinya tindak pidana antara lain memberikan pembinaan secara intensif terhadap pelaku tindak pidana pembuangan bayi sejak pelaku menjadi tahanan polisi. ABSTRACT In writing this thesis, the writer discusses about the policy the Sukoharjo Resort Police takes in disclosing the criminal action case of baby disposal and the attempt of coping with and minimizing it by the Sukoharjo Resort Police together with the government and community. It is foreshadowed by the increased number of baby disposal criminal action cases that is difficult to disclose because of various obstacles the Police encounters, particularly the Sukoharjo Resort. The objective of research is to find out and to analyze the policy the Sukoharjo Resort Police had conducted in disclosing the baby disposal case by its own mother, to find out and to study the attempt of coping with the baby disposal criminal action the Sukoharjo Resort Police conducts with the government and community. This study belongs to a sociological (non doctrinal) law research type that is descriptive qualitative in nature using the primary and secondary data in the form of interview with the Criminal Investigation Bureau’s Members of Sukoharjo Resort Police. The result of research reveals that the policy taken by the Sukoharjo Resort Police in disclosing the baby disposal criminal action case is by checking the hospitals particularly maternity center, publication or newspaper exposition, either printer or electronic media, and by undertaking the investigation process. The policy taken by the Sukoharjo Resort Police to the actor of baby disposal criminal action considers the status of the actor whether or not she still studies at school, if she still studies at school the reporting obligation on Monday and Thursday rather than arrest is imposed so that she still can continue her education. The obstacles the Sukoharjo Resort Police faces in disclosing such cases is that the actor commits her action outside her residence, the actor disguises her pregnancy, and she is less proactive within the community. A variety of attempts to cope with the baby disposal has also been undertaken by the Sukoharjo Resort Police including providing the assistance and illumination to the community through Bina Mitra, activating the self-intention (swakarsa) security system in the community neighborhood through the daily environment patrol, undertaking the community disease raids as well as blue VCD circulation raids, and after the criminal action incidence including giving a intensively building to the actor of baby disposal since the actor becomes the Police’s prisoner.
