× ABSTRAK Penelitian ini bertujuan mendeskripsikan dan menganalisis penerapan prinsip pembedaan dalam konflik bersenjata antara pemerintah Sri Lanka dan pemberontak Macan Tamil. Penelitan ini termasuk jenis penelitian hukum normatif, yang ditinjau dari sifatnya bersifat preskriptif. Jenis bahan hukum yang digunakan adalah bahan hukum primer, dan bahan hukum sekunder. Teknik pengumpulan bahan hukum yang dipergunakan, yaitu studi pustaka. Teknik analisis data yang digunakan ialah teknik metode deduksi. Berdasarkan hasil penelitian dan pembahasan dihasilkan simpulan yakni penerapan prinsip pembedaan dalam Konflik Bersenjata Non Internasional antara Pemerintah Sri Lanka dan Pemberontak Macan Tamil tidak sesuai dengan aturan prinsip pembedaan yang terdapat dalam hukum humaniter internasional yang seharusnya berlaku. Hal ini terlihat dari banyaknya jumlah penduduk sipil yang tewas dalam konflik serta adanya sejumlah kejadian penyerangan dan pembunuhan brutal terhadap penduduk sipil ataupun objek sipil lainnya. Kata kunci: Prinsip Pembedaan, Konflik bersenjata di Sri Lanka, Perlindungan penduduk sipil ABSTRACT This research was aimed to know whether the land acquisition process of City Ring Road construction by Wonogiri regency government was appropriate due to the valid constitution, including the gradually practical process starting from location decision scheming until the agreement achievement of loss of land, buildings, plants, either other materials on it. This research was a normative law with prescriptive nature, discovering the in concreto law whether or not the procurement procedures is in accordance with the existing land laws. Types of data used are secondary data. Secondary data sources that were used included the primary legal materials, legal materials, secondary and tertiary legal materials. Data collection techniques used were literature studies and interviews with officials Wonogiri land procurement committee to clarify the obtained data. Data analysis was performed with the interpretation of laws and regulations, regarding the procurement of land (the major premise) that was used as reference to assess the truth of the law the land acquisition process for Wonogiri City Ring Road (minor premise). To achieve the answers due to the suitability of land procurement procedures, deductive syllogism was being used. Based on the findings and discussions, conclusions were obtained, First, the reason for the land acquisition procedures for Wonogiri City Ring Road did not comply the statutory regulations, in the matter that the Land Price Appraisal Team members Wonogiri were not in accordance with the composition specified in the legislation, then it was feared could harm the owner of the land because land prices were determined by the parties that requires the land so that prices tend to be below the normal market. Second, between the landowners and institution which was in need of land, in this case the Wonogiri government, both parties could reach an agreement on compensation for loss of land, buildings, plants, other objects either money on it.
