This research aims to find out the implementation of adjustment confiscation (vergelijkende beslag) in Surakarta First Instance Court in the Civil Dispute Number: 66/Pdt.G/2009/PN.Ska and to find out the obstacles in theimplementation of adjustment confiscation (vergelijkende beslag) in Surakarta First Instance Court. This study belongs to an empirical research that is descriptive in nature using qualitative approach. The types of data consisted of primary datain the form ofinterviews withjudgesandbailiffand secondary datain the formofverdict. Techniques of collecting data used were interview and library study. The data was analyzed qualitatively using an interactive model of analysis.
The implementation of adjustment confiscation (vergelijkende beslag) inSurakarta First Instance Court occurs because thefiling ofthe lawsuitsequestration, but afterrunningitthe objectthat becameknown tothe Plaintiffhadpledgedcollateralin the bank, so that thePlaintiff's attorney to apply foradjustment confiscation (vergelijkende beslag)to the District Courtof Surakartato guaranteetheir rights,which is thengrantedby ajudgeandordered thecourt clerkorbailiff, signed by thebailiffhimselfandtwomenas witnesses, thenlistedorregisteredin abookof land inthe Nationalland Agency(BPN) which statesthat the landorthe object isalreadyin thesequestrationadjustment. The obstacles found in the dispute include: firstly, the disputed object is out of Surakarta First Instance’s jurisdiction, therefore, the solution is the Surakarta First Instance ask for help from the local First Instance. Secondly, there is a declination from the accused party, so that the court resorts mediation way.
