Pusat P2H).

Fasilitas Dana Bergulir (FDB) untuk Pembiayaan Usaha Hutan Tanaman adalah salah satu program
Kementerian Kehutanan dalam rangka memberikan akses kepada masyarakat untuk berpartisipasi dalam
pembangunan hutan tanaman. Penyaluran FDB untuk Pembiayaan Usaha Hutan Tanaman diharapkan dapat
menyejahterakan masyarakat khususnya di sekitar hutan, namun dalam pelaksanaannya disamping terdapat
faktor-faktor yang mendukung, terdapat pula faktor-faktor yang menghambat.
Penelitian ini bertujuan untuk mengetahui faktor-faktor yang mendukung dan faktor-faktor yang
menghambat serta upaya yang dilakukan untuk mengatasi hambatan dalam Pelaksanaan Penyaluran FDB
untuk Pembiayaan Usaha Hutan Tanaman.
Penelitian ini merupakan jenis penelitian hokum sosiologis/empiris yang bersifat deskriptif dengan
bentuk penelitian yang digunakan adalah diagnostik. Analisis datanya menggunakan analisis kualitatif.
Berdasarkan hasil penelitian dan pembahasan dengan menggunakan teori van Meter dan van Horn dan
teori bekerjanya hukum Lawrence Meir Friedman, maka Pelaksanaan Penyaluran FDB untuk Pembiayaan
Usaha Hutan Tanaman belum optimal. Faktor-faktor yang mendukung maupun faktor-faktor yang
menghambat, adalah sebagai berikut: 1) Substansi: Faktor pendukungnya adalah, adanya seperangkat
peraturan mulai peraturan pemerintah mengenai Dana Reboisasi, sampai peraturan Kepala Pusat P2H yang
mengatur secara teknis mengenai penyaluran FDB untuk Pembiayaan Usaha Hutan Tanaman; Faktor
penghambatnya adalah, belum ada landasan operasional terkait Hutan Kemasyarakatan, Hutan Desa, Usaha
Pemanfaatan Hasil Hutan Bukan Kayu, Pengayaan Tegakan di Hutan Alam pada Kawasan Hutan Produksi
dengan teknik Silin serta Restorasi Ekosistem; Upaya yang dilakukan adalah pembahasan dan penyusunan
peraturan operasional terkait kegiatan usaha hutan tanaman yang masih belum ada aturannya. 2) Struktur
Hukum: Faktor pendukungnya adalah tata organisasi dan kapasitas pemimpin yang baik, serta kerjasama dan
koordinasi yang baik dengan Lembaga Swadaya Masyarakat dalam melaksanakan sosialisasi; Faktor
penghambatnya adalah masih kekurangan baik secara kuantitas maupun kapasitas pegawai, kurangnya
koordinasi antar instansi; Upaya yang dilakukan adalah pengembangan Sistem Informasi
Manajemen/Teknologi Informasi, peningkatan peran Bank Rakyat Indonesia (BRI) sebagai mitra dalam
peningkatan kapasitas kelembagaan dan Sumber Daya Manusia BLU Pusat P2H, pengembangan Lembaga
Penyalur Dana Bergulir Perantara, serta melakukan koordinasi antar instansi pemerintah yang terkait dalam
pelaksanaan kebijakan secara lebih intensif.3) Budaya Hukum: Faktor pendukungnya adalah masyarakat
terbuka dengan program-program pemerintah termasuk kebijakan pembangunan hutan tanaman, Faktor
penghambatnya adalah kurangnya kesadaran masyarakat dalam penggunaan dana bergulir sesuai ketentuan;
Upaya yang dilakukan adalah meningkatkan kesadaran masyarakat yaitu dengan memberikan sosialisasi agar
mempunyai pemahaman yang benar mengenai FDB untuk Pembiayaan Usaha Hutan Tanaman, penyaluran
pinjaman dilakukan secara bertahap untuk menghindari penyalahgunaan dana bergulir oleh debitur,
mencantumkan dalam akad kredit syarat-syarat penyaluran FDB serta sanksi yang diberikan apabila debitur
tidak melaksanakan kegiatan sesuai persyaratan setelah FDB disalurkan.
Disarankan kepada BLU Pusat P2H perlu segera disusun dan diterbitkan peraturan-peraturan terkait
Hutan Kemasyarakatan, Hutan Desa, Usaha Pemanfaatan Hasil Hutan Bukan Kayu, Pengayaan Tegakan di
Hutan Alam pada Kawasan Hutan Produksi dengan teknik Silvikultur intensif serta Restorasi Ekosistem serta
peraturan mengenai Hutan Rakyat dengan pola penyaluran melalui lembaga perantara. Perlunya penambahan
staf yang berlatar belakang hukum, akuntansi dan perbankanserta perlunya koordinasi yang lebih intensif
dengan pemerintah daerah, bila perlu dengan membuat nota kesepahaman agar terjalin kerjasama yang lebih
baik. BLU Pusat P2H masih perlu melakukan sosialisasi kepada masyarakat secara luas terkait FDB untuk
Usaha Hutan Tanaman bila perlu dengan merangkul tokoh masyarakat yang disegani.

The revolving fund facility for the plantation forestry business funding is one of the programs of the
Ministry of Forestry so as to extend an access to community to participate in the plantation forestry
development. The distribution of the revolving fund facility for the plantation forestry business funding is
expected to prosper the communities, particularly those surrounding the forest. However, in its implementation
in addition to supporting factors, there are some inhibiting factors.
The objectives of this research are to investigate: (1) the supporting and inhibiting factors to the
implementation of revolving fund facility distribution for the plantation forestry business funding as well as
the efforts done to deal with such inhibiting factors.
This research used the sociological/empirical descriptive law research method with the diagnostic
approach. The data of the research were analyzed by using the qualitative technique of analysis.
The results of the research show that based on the theory claimed by van Meter and van Horn and the
working law theory claimed by Lawrence Meir Friedman, the implementation of revolving fund facility
distribution for the plantation forestry business funding has not been optimal. The supporting and inhibiting
factors to such an implementation are as follows: 1) Legal Substance: The supporting factor is a set of
regulations from Regulation of the government regarding reforestation funds to Regulation of Head of the
General Service Agency for the Center of Forestry Development Funding, which technically regulates the
implementation of revolving fund facility distribution for the plantation forestry business funding. Meanwhile,
the inhibiting factor includes the unavailability of operational bases related to community forestry, village
forestry, village forest, utilizationof non-timber forest products, and enrichment of forest stands in natural
forests within production forest area through intensive silviculture and ecosystem restoration. The efforts done
to deal with such constraints are discussing and arranging operational regulations related to plantation forestry
businesses which have not been supported with such regulations. 2) Legal Structure: The supporting factors
are good organizational structure, good leadership capacity and good cooperation and coordination with nongovernmental
organizations to conduct socializations, whereas the inhibiting factors include the lack of
number and capacity of personnel and the lack of inter-institutional coordination. The efforts done to deal with
such constraints developing management information system/information technology, improving the role of
Bank Rakyat Indonesia (People’s Bank of Indonesia) as a partner in improving the institutional capacities and
human resources of General Service Agency for the Center of Forestry Development Funding, developing
revolving fund executing institution, and intensively coordinating the related inter-government institutions in
the policy implementation. 3) Legal Culture: the inhibiting factor includes the disclosure of community toward
the government’s programs including the policy on plantation forestry development. Meanwhile, the inhibiting
factor includes the community’s lack of awareness toward the utilization of revolving fund in accordance with
the prevailing regulations. The efforts done to deal with such constraints are improving the community’s
awareness by extending socialization so that they bear the right understanding about revolving fund facility for
plantation forestry business funding, the channeling of loans is done in phases to avoid misuse of the revolving
fund by debtors, listing the requisites of the revolving fund distribution and the sanctions that will be imposed
to them when they do not implement their activities according to the prevailing requisite following the
revolving fund.
Based on the results of the research, the General Service Agency for the Center of Forestry
Development Funding is recommended to immediately arrange and issue regulations related to community
forestry, village forest, utilizationof non-timber forest products, and enrichment of forest stands in natural
forests within production forest area through intensive silviculture and ecosystem restoration and those related
to community forests with the distribution through intermediary institutions. Besides, the number of personnel
with law, accounting, and banking backgrounds shall be added, a more intensive coordination with the local
government is required and if necessary, memorandum of understanding shall be made so that a better
cooperation is established. In addition, a thorough socialization to community on the revolving fund facility
for the plantation forestry business shall be conducted. If deemed necessary, it can be done by involving
respectable community figures.
