ABSTRACT

This research is focused on two issues, they are: 1) the type of law terms
and the translation techniques applied in translating law terms in the translated
novel entitled The Confession and 2) the impact of the translation techniques
on the translation quality in terms of accuracy, acceptability, and readability.
Belonging to descriptive qualitative study, this research uses purposive
sampling technique in searching the data from the novel. There are 218 data of
legal terms, they are law terms belonging to abstract concepts (121 data), law
terms belonging to legal professions (63 data), and law terms belonging to
court names (31 data). Another data are taken from the translation quality
assessment of three raters and three respondents. All of the informants are also
chosen by using purposive sampling technique.
The result of analysis provides two results. The first is the type of the law
terms and the translation technique to translate them. There are 7 techniques
which are applied in translating law terms belonging to abstract concepts, 11
techniques for translating law terms belongin to legal professions, and 8
techniques for translating law terms belonging to court names. The number of
data translated by using those techniques are: 94 data (43.1%) of Established
Equivalence, 38 data (17.4%) of Partial Equiavelence, 28 data (12.8%) of
Amplification, 17 data (7.8%) of Non-Equivalence, 14 data (6.4%) of
Particularization, 9 data (4.1%) of Generalization, 6 data (2.7%) of Couplet, 3
data (3.2%) of Modulation, 2 data (0.9%) of Reduction, Addition, and
Substitution, and 1 data (0.4%) of Borrowing, Omission, and Adaptation. The
second is the translation quality of the translation. Most of the data in each type
of law terms belong to accurate, acceptable, and readable translation, they are
144 data (66.05%) of accurate translations, 158 data (72.4%) of acceptable
translations, and 152 data (69.7%) of readable translations.
The research findings indicates that Established Equivalence is dominantly
used to translate each type of legal terms, they are: 1) in law terms belonging to
abstract concepts, 50 data (41.3%) are accurate, 56 data (46.2%) are
acceptable, and 53 data (43.8%) are readable; 2) in law terms belonging to
legal professions, 19 data (30.1%) are accurate, 20 data (31.7%) are acceptable,
and 19 data (30.1%) are readable; and 3) in legal terms belonging to court
names, 7 data (22.5%) are accurate, 2 data (3.1%) are acceptable, and 6 data
(9.5%) are readable. The highest acceptable translations in law terms belonging
to court names is Non-Equivalence. It is due to the fact that most of legal terms
could be recognized in legal dictionary thus the translator applies Established
Equivalence technique. While, Non-Equivalence technique is more acceptable
because the different of legal system impacts on the name of legal institutions.
Thus, the translator paraphrases the original term to make it more familiar.
