TELAAH PROSES PENGHENTIAN PENUNTUTAN BERDASARKAN PRINSIP RESTORATIVE JUSTICE (STUDI KASUS BERKAS PERKARA NOMOR BP/50/IV/2022/RESKRIM PADA KEJAKSAAN NEGERI SURAKARTA).  Penulisan hukum ini bertujuan untuk mengetahui keberjalanannya proses penghentian penuntutan berdasarkan prinsip Restorative Justice pada berkas perkara nomor BP/50/IV/2022/Reskrim di Kejaksaan Negeri Surakarta serta kesesuaian penerapannya terhadap peraturan perundang-undangan yang berlaku. Penelitian ini merupakan penelitian hukum normatif yang bersifat preskriptif dan terapan dengan jenis bahan hukum yang digunakan adalah bahan hukum primer, bahan hukum sekunder, dan bahan non-hukum. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan konseptual (conceptual approach) dan pendekatan studi kasus (case study) yang merupakan bagian dari pendekatan kasus (case approach) dengan teknik pengumpulan bahan hukum studi kepustakaan serta menggunakan metode silogisme melalui penalaran deduktif sebagai teknik analisis bahan hukum. Adapaun hasil penelitian pada penulisan hukum ini adalah bahwa pada penerapan proses penghentian penuntutan berdasarkan prinsip Restorative Justice pada berkas perkara nomor BP/50/IV/2022/Reskrim di Kejaksaan Negeri Surakarta yang melanggar Pasal 378 KUHP tentang Penipuan atau Pasal 372 KUHP tentang Penggelapan dengan tersangka atas nama Mita Rusdiana alias Mita binti Triyanto (Alm) telah memenuhi seluruh prinsip Restorative Justice serta unsurunsur yang berlaku dalam Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif dengan memperhatikan kondisi harmonisasi sosial untuk mewujudkan rasa keadilan dan kepercayaan masyarakat terhadap hukum yang berlaku.

The legal writing aims to determine the progress of the process of stopping prosecution based on Restorative Justice principle in the case file number BP/50/IV/2022/Reskrim at the Surakarta District Attorney and the suitability of its application to the applicable laws and regulations. This research is normative legal research that is prescriptive and applied with the types of legal materials used are primary legal materials, secondary legal materials, and non-legal materials. The approach used in this study is the conceptual approach and case study which is part of the case approach with the technique of collecting legal materials, literature studies, and using the syllogistic method through deductive reasoning as a technique for analyzing legal materials. As for the results of research on the writing of this law is that the application of the process of stopping prosecution is based on Restorative Justice principle in the case file number BP/50/IV/2022/Reskrim at the Surakarta District Attorney's Office which violated Article 378 of the Criminal Code (Pasal 378 KUHP) on Fraud or Article 372 of the Criminal Code (Pasal 372 KUHP) on Embezzlement with the suspect on behalf of Mita Rusdiana alias Mita binti Triyanto (Alm) has fulfilled all principles Restorative Justice as well as the elements that apply in the Attorney General's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice by taking into account conditions of social harmonization to create a sense of justice and public trust in applicable law.
