This study aims to analyze the role of the Witness and Victim Protection Agency (LPSK) in calculating the amount of restitution submitted by victims of criminal acts through the public prosecutor, as well as to analyze the judges’ considerations in deciding restitution claims in Decision Number 41/Pid.B/2024/PN Kpg based on Supreme Court Regulation Number 1 of 2022. This research is a prescriptive normative legal study employing both case and statutory approaches. The legal materials consist of primary and secondary legal sources analyzed through deductive syllogism methods. The results of the study indicate that the role of LPSK in the restitution calculation process has not been fully optimal due to weaknesses in the verification and validation process of victims’ loss documents submitted through the public prosecutor. This condition caused several restitution claims to be disputed by the defendants’ legal counsel and ultimately resulted in a reduction of the restitution amount granted by the panel of judges. Furthermore, the judges’ considerations in deciding restitution in Decision Number 41/Pid.B/2024/PN Kpg generally referred to the provisions of Supreme Court Regulation Number 1 of 2022, particularly regarding the fulfillment of victims’ restitution rights. However, the judgment did not comprehensively elaborate on the assessment of the validity of the evidence relating to the victims’ losses. Therefore, stronger coordination between LPSK, public prosecutors, and other law enforcement authorities is necessary to ensure that the implementation of restitution provides optimal legal protection and recovery for victims’ rights.
