ABSTRAK
Penulisan hukum ini adalah mengenai analisis kewenangan pemerintah dalam
pengaturan subsidi bahan bakar minyak (bbm) ditinjau dari konsep welfare state
dan pasal 33 undang undang dasar negara republik indonesia tahun 1945:
Bagaimanakah Kewenangan Pemerintah Dalam Memberikan Subsidi Bahan
Bakar Minyak (BBM) Ditinjau Dari Konsep Welfare State ?Apakah Kewenangan
Pemerintah Dalam Kebijakan Subsidi Bahan Bakar Minyak (BBM) Sudah sesuai
koheren dengan Pasal 33 Undang Dasar Negara Republik Indonesia Tahun 1945 ?
Jenis penelitian ini adalah penelitian hukum yang bersifat preskriptif dan terapan.
Pendekatan yang digunakan adalah pendekatan konseptual (Conceptual
Approach). Teknik pengumpulan bahan hukum yang digunakan adalah studi
kepustakaan. Teknik analisis yang digunakan adalah dengan analisis silogisme
deduktif. Indonesia sebagai negara yang menganut konsep welfare state .Hal
tersebut terlihat dari sejarah pembentukan dan tujuan negara Indonesia.implikasi
dari konsep welfare state adalah negara berwenang melindungi masyarakat
melalui intervensi terhadap common good demi kesejahteraan masyarakat. BBM
sebagai salah satu common goods dan telah diatur dalam konstitusi pasal 33 ayat
(2) dan (3) Subsidi BBM merupakan salah satu bentuk keadilan melalui
pendekatan komunitarianisme. Kebijakan subsidi BBM dalam UU No.4 Tahun
2012 dan Perpres No. 15 Tahun 2012 tidak sesuai dengan pasal 33 UUD
1945.Kebijakan subsidi BBM dalam Peraturan Menteri ESDM No. 34 Tahun
2014 dan Peraturan Menteri ESDM No. 39 Tahun 2014 tidak sesuai dengan pasal
33 UUD 1945. Kebijakan subsidi BBM dalam Peraturan Meteri ESDM No. 39
Tahun 2014 dan Peraturan Menteri ESDM No. 4 Tahun 2015 dikaitkan dengan
UU No.27 Tahun 2014 Tentang APBN 2015 apabila ditinjau dari pasal 33
Konstitusi masih belum sesuai. Namun subsidi BBM tidak dicabut, melainkan
dialihkan dalam bentuk lain yang mungkin mensejahterakan masyarakat

ABSTRACT
This writing analyze the government authority in the regulation of fuel subsidy
policy based on the concept of welfare state and article 33 of the constitution of
the republic Indonesia Year 1945 ( UUD 1945). How does the government
Authority on Providing Fuel Subsidy From the perspective of Welfare State? Is
the Government Authority In Fuel Subsidy Policy inhenrent with the Article 33
Constitution of the Republic of Indonesia Year 1945 ( UUD 1945) ? This research
is normative, prescriptive and applied legal research. The approach used is the
conceptual approach . Legal materials collection technique used is the study of
literature. The analysis technique used is the analysis of deductive syllogism.
Indonesia are a country that embrace the concept of welfare state . It can be seen
from the history and purpose of the formation of the Republic of Indonesia. The
implication of embracing the welfare state concept is that the state are having the
obligation and authorities to protect the public through the intervention of the
common good for the welfare of society. Fuel as one of the common goods and
has been mentioned within the constitution on article 33 paragraph (2) and (3).
The fuel subsidy is a form of justice within communitarian concept. Fuel Subsidy
policy in Act 4 of 2012 and Presidential Decree No. 15 The year 2012 was not
inherent with the Article 33 of the UUD 1945. Fuels subsidy policy on the
Regulation of the Minister of Energy and Mineral Resources No. 34 Year 2014
and the Regulation of the Minister of Energy and Mineral Resources No. 39 2014
is not inherent the Article 33 of the UUD 1945. Subsidy policy in the Regulation
of Minister of Energy and Mineral Resources No. 39 Year 2014 and the
Regulation of the Minister of Energy and Mineral Resources No. 4 2015 is
associated with the Act No.27 of 2014 About 2015 Budget still not inherent with
the article 33 of the UUD 1945. Even so, the fuel subsidy are not removed, but
rather transferred to other possible forms of public welfare
